theFurnace.ai — AI Services Agreement and Disclosure

Effective date: 2026-09-22

This agreement covers the artificial-intelligence features of theFurnace.ai's services, provided by Capital Commission Management, LLC d/b/a theFurnace.ai ("theFurnace," "we," "us"). It is part of the Terms of Service. Capitalized terms have the meanings given there.

1. What CHLOE is

CHLOE is our AI texting assistant ("CHLOE" here means the assistant feature whatever its current name; we may rename it at any time). It holds text conversations with your leads in your name at your direction: sending opening messages, answering replies, handling objections, and booking appointments onto your calendar. Messages are generated by automated systems in real time, based on algorithms, machine-learning models, standardized flows, third-party data, and the inputs and instructions associated with your account.

2. What you authorize and adopt

You authorize the AI features to send and receive communications in your name and to book appointments onto your connected calendar. You acknowledge that messages send automatically, without your individual pre-approval, and you adopt every AI-generated message sent through your account as your own communication for all purposes. You may pause the service at any time by asking us.

3. No guarantee of accuracy

AI output is probabilistic. The AI features may:

  • generate inaccurate, incomplete, outdated, off-script, or non-compliant content;
  • misinterpret a reply, a lead file, or an instruction;
  • hallucinate, fabricate information, or behave unpredictably;
  • book, reschedule, or mishandle an appointment incorrectly;
  • fail to detect an error, a compliance risk, or a consumer's intent.

AI-generated output should never be relied on as factual, legal, financial, insurance, tax, compliance, or professional advice.

4. You assume all risk

YOU USE THE AI FEATURES ENTIRELY AT YOUR OWN RISK. You are solely responsible for monitoring your account, conversations, bookings, and results; for verifying anything you rely on; for all decisions, communications, and business activity resulting from the AI features; and for promptly reporting anything that looks wrong. We may monitor, test, and improve the AI features across our platform, but we have NO OBLIGATION to review, approve, or supervise any individual message, conversation, or booking, and our monitoring or improvement of the system creates no duty to you.

5. AI outputs are provided as-is

ALL AI FEATURES AND AI-GENERATED OUTPUTS ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITH ALL FAULTS, WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, COMPLIANCE, OR ERROR-FREE OPERATION.

6. No liability for AI outputs

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEFURNACE AND ITS MEMBERS, MANAGERS, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AI PROVIDERS, AND AGENTS ARE NOT LIABLE FOR ANY DAMAGES OR LIABILITIES ARISING FROM OR RELATING TO THE AI FEATURES, INCLUDING: incorrect or fabricated outputs; AI hallucinations; miscommunications with consumers; appointment or scheduling errors; carrier filtering or deliverability issues; TCPA or telemarketing claims; regulatory actions; compliance violations; consumer disputes; lost revenue, profits, or opportunities; or data loss, EVEN IF ADVISED OF THE POSSIBILITY. All liability that survives this section is subject to the limitation-of-liability cap in the Terms of Service. Occasional AI errors are inherent to the technology, are not a breach of contract, and are not grounds for refund.

7. No professional advice; no licensed activity

The AI features book appointments. They do not give insurance, legal, financial, tax, or medical advice, and no advisory, fiduciary, or professional relationship is created by them. All licensed activity, product recommendations, quotes, and sales are yours, between you and the consumer, under your licenses. You are responsible for everything that happens on and after a booked appointment.

8. Consumer opt-outs and disclosure

Consumers can opt out at any time by replying STOP; opt-outs are honored immediately and permanently. When a consumer directly asks whether they are talking to a human or an automated system, CHLOE does not claim to be human.

9. Third-party AI providers

The AI features use third-party models, APIs, and infrastructure. We make no representation or warranty about third-party model reliability, availability, output quality, security, or uptime, and their acts and outages are not our responsibility.

10. Indemnification

The indemnification in the Terms of Service expressly covers AI-related claims, including claims arising from AI-generated communications sent on your behalf, reliance on AI outputs, appointment errors, TCPA or telemarketing claims, regulatory investigations, and consumer disputes.

11. Your data and AI improvement

Conversations the AI features hold on your behalf are used to operate your account and to improve performance across our platform (for example, learning which messages book appointments). We do not sell your conversation data. See the Privacy Policy.

12. Acceptance

By buying or using the services you acknowledge that AI systems are inherently imperfect and may produce incorrect outputs, that you assume full responsibility for use of the AI features, and that theFurnace is not responsible for damages arising from AI-generated content or actions, as set out above and in the Terms of Service.
